Lifting the Supreme Court Ban on Patenting Human Genes



Controversial U.S. bill would lift Supreme Court ban on patenting human genes



In 2019, a new congressional bill attempted to change the U.S. Supreme Court decision that banned the patenting of human genes. This bill aims to address problems with biotechnology and software industries that claim the patent eligibility rules have been confusing and overly strict. The most recent rulings that will be affected are the 2012 Mayo Collaborative Services v. Prometheus Laboratories, 2013 Association for Molecular Pathology (AMP) v. Myriad Genetics Inc., and the 2014 Alice Corp. v. CLS Bank International. This new bill will clarify the language used in past rulings and clear the air of any misunderstandings. Many suggest that we continue conversations about the patent statute as scientific discovery and research change quickly over time.
