How do gene patenting laws vary between countries - International Divergence in Gene Patenting


This journal article and attached news article give an overview of the history of gene patenting laws and the current status of gene patenting laws in different countries. The information from both the scientific article and new article have been merged together in Table 1. In an effort to standardise patenting law, it became a requirement of joining the World Trade Organisation to join the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). Despite original international cooperation to standardise these laws, the specifics and details of these new technologies have become interpreted differently in different legal systems.

Interestingly the article also mentions another study in which it found that 85% of cases which have been dismissed on the basis of the AMP vs. Myriad ruling, did not actually refer to situations of isolated DNA, but infer the ruling on a different type of genetic methodology.
